These Terms of Service ("Terms") govern your access to and use of @-Social™ (the "Platform"), operated by Seranya Beck (operating name; full legal name held privately) ("we," "us," or "our"), a sole proprietor based in the Greater Toronto Area, Ontario, Canada. By creating an account or using the Platform in any way, you agree to these Terms in full. If you do not agree, do not use the Platform.
1. Eligibility
You must be at least 13 years of age to use @-Social. If you are between 13 and 18, you must have the consent of a parent or legal guardian. By using the Platform, you confirm that you meet these requirements and that you have the legal capacity to enter into a binding agreement.
We do not knowingly collect personal information from children under 13. If we learn that a user under 13 has created an account, we will delete it.
2. Related Sites
We operate two websites. at-social.com is the Platform itself — where you create an account, post content, and use the features these Terms govern. at-social.social is a separate promotional site that hosts a standalone tool (currently, a platform-fee calculator) and an email signup form; it is not the Platform, does not require an account, and is not where you create or manage @-Social content. Both sites are operated by us, and both are covered by our Privacy Policy, which explains what limited information each site collects.
3. Your Account
Account registration, login, and session management are still being built and are not yet live on the Platform. The provisions below describe how accounts will work once this ships, so the Terms are ready in advance — until then, most of this section does not yet apply in practice.
3.1 Registration. Once available, you will need to provide accurate, complete, and current information when creating an account, and to keep that information up to date.
3.2 Security. Once available, you will be responsible for keeping your login credentials confidential, and for all activity that occurs under your account. Notify us immediately at legal@at-social.com if you suspect unauthorized access.
3.3 One account per person. Once accounts exist, you may not create multiple accounts to evade a suspension or ban, or to misrepresent your identity.
3.4 Suspension and termination. We may suspend or terminate your account at any time if you violate these Terms or if we determine, in our sole discretion, that your use of the Platform is harmful to other users or to the Platform. In the meantime, before accounts exist, we may restrict your access to the Platform for the same reasons. We will make reasonable efforts to notify you before taking action, except where immediate action is necessary to protect others.
4. User-Generated Content
4.1 Ownership. You retain full ownership of the original text, images, artwork, audio, and other content you post on @-Social ("Your Content"). These Terms do not transfer any intellectual property rights from you to us.
4.2 License to us. By posting Your Content on the Platform, you grant @-Social a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute Your Content solely to operate and provide the Platform and its features. This license ends when you delete Your Content or close your account, subject to any retention required by law or our backup procedures (typically deleted within 30 days).
4.3 Your representations. By posting content, you represent and warrant that:
- You own the content or have the rights necessary to post it and grant us the license above.
- Your content does not infringe any third party's intellectual property rights, privacy rights, or other legal rights.
- Your content complies with these Terms and our Code of Conduct.
4.4 Content removal. We reserve the right to remove any content that violates these Terms, our Code of Conduct, or applicable law, without prior notice.
5. Acceptable Use
You agree not to use the Platform to:
- Post or transmit content that is harassing, threatening, defamatory, obscene, or hateful.
- Infringe any third party's intellectual property, privacy, or other rights.
- Spread misinformation, impersonate another person or entity, or misrepresent your identity.
- Send spam, unsolicited promotions, or repetitive or deceptive messages.
- Distribute malware, viruses, or other harmful code.
- Scrape, crawl, or extract data from the Platform by automated means without our prior written consent.
- Attempt to gain unauthorized access to any part of the Platform or another user's account.
- Use the Platform in any way that violates applicable law, including Canadian federal law, Ontario provincial law, or any other applicable jurisdiction.
6. Creator Storefronts (DOTfronts) and DOT-filiates
6.1 0% commission (Anti-Lock-In Covenant). @-Social does not take a percentage of any creator's sales. Creators always keep 100% of what they earn through their DOTfront — this does not change based on plan tier, feature usage, or any other factor. If a creator chooses to offer a DOT-filiate commission on one of their products, the creator alone decides whether to offer one and sets its rate; @-Social does not set, take, or influence that commission.
6.2 Creator responsibility. Creators who list products or services through their DOTfront (a creator storefront on the Platform) are solely responsible for the accuracy of their listings, the quality of their products or services, and their compliance with applicable law, including any obligation to collect and remit sales, use, VAT, GST/HST, or similar taxes on their sales.
6.3 Transactions. Payment for creator sales is intended to move through Stripe Connect, directly between buyer and creator — @-Social is not the seller of record, and does not hold, generate, or transmit funds of any kind. Payment details are handled directly by Stripe and are never stored on @-Social's servers.
6.4 DOT-filiates. Any user may generate a personal DOT-filiate referral link to a creator's product. The commission relationship created by a DOT-filiate referral is between the referring DOT-filiate and the creator whose product was purchased — @-Social is not a party to that underlying commission arrangement, and does not set, hold, or move any commission funds. We operate the referral-tracking infrastructure that identifies which DOT-filiate referred a sale; these Terms govern your use of that infrastructure.
- Attribution. Attribution is based on the referral link present at the time of checkout on a last-touch basis. We do not use tracking cookies or other persistent client-side storage for this purpose; if a visitor leaves the checkout page and returns later without the referral link, the referral is not preserved.
- Fraud prevention. We log limited technical information about referred visits (see our Privacy Policy) solely to verify that a genuine visit occurred before a referral is credited.
- Commission terms. The creator sets the commission rate (if any) for DOT-filiates on their products. @-Social does not set or receive any part of that commission.
- Refunds and chargebacks. If a purchase attributed to a DOT-filiate is later refunded or charged back, the associated commission is not payable, or is reversed if already paid.
- Prohibited conduct. You may not refer your own purchases, coordinate with others to generate artificial referrals, or otherwise manipulate referral attribution to receive commissions you have not legitimately earned. Violations may result in forfeiture of unpaid commissions and account suspension or termination under Section 3.4.
- Payouts. DOT-filiate commissions are intended to be paid directly to DOT-filiates via Stripe Connect, without @-Social holding, generating, or transmitting any funds. This payout mechanism is still being built; DOT-filiate status itself is tracked today, but until payouts are live, no commission can be paid out.
- Dedicated agreement. Additional DOT-filiate mechanics — including minimum payout thresholds and payout timing, once payouts are live — are set out in a dedicated DOT-filiate Agreement.
6.5 Disputes and refunds. Any dispute between a buyer and a creator, including requests for a refund, is between those parties and is governed by the creator's own refund or return policy, if any. @-Social does not guarantee refunds on creator purchases and is not the seller of record. We encourage creators to post a clear refund policy on their DOTfront. Buyers with concerns about fraud, misrepresentation, or a Code of Conduct violation may still report the matter to us under our Safety Reporting Policy.
6.6 No guarantees. We do not guarantee the accuracy of any creator listing or the quality, safety, or legality of any product or service sold through the Platform.
7. Intellectual Property of the Platform
All rights to the @-Social Platform itself, including its design, software, trademarks, and the PHULOS™ backend technology, are owned by or licensed to Seranya Beck (operating name; full legal name held privately). You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without our prior written consent.
The @-Social™ name, logo, and PHULOS™ mark are trademarks of Seranya Beck (operating name; full legal name held privately). Nothing in these Terms grants you any right to use them.
8. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read the Privacy Policy carefully before using the Platform.
9. Third-Party Services and Links
The Platform may contain links to or integrations with third-party websites or services, including Stripe and other payment processors or payment methods we may support. We do not control those services and are not responsible for their content, practices, or policies. Accessing a third-party service through the Platform is at your own risk.
10. Disclaimer of Warranties
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The Platform will be uninterrupted, error-free, or secure.
- Any content on the Platform is accurate, complete, or reliable.
- The Platform will meet your specific requirements.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Seranya Beck (operating name; full legal name held privately) and @-Social will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the Platform, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to these Terms or the Platform will not exceed the amount you paid us (if any) in the 12 months preceding the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable Canadian law, including Ontario's Consumer Protection Act, 2002.
12. Indemnification
You agree to indemnify and hold harmless Seranya Beck (operating name; full legal name held privately) and @-Social from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Platform; (b) Your Content; or (c) your violation of these Terms or any applicable law.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict of law principles.
Any dispute arising under these Terms will be resolved through good-faith negotiation first. If negotiation fails, disputes will be subject to the exclusive jurisdiction of the courts of the Province of Ontario.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated Terms on this page and update the "Last Updated" date. If changes are material, we will notify you by email or by a prominent notice on the Platform. Your continued use of the Platform after changes take effect constitutes your acceptance of the updated Terms.
